N.Y. Judges Get Go-Ahead To Sue Over Pay Freeze

Law360, New York (February 6, 2008, 12:00 AM EST) -- A New York judge has given the green light to a suit brought by four of his colleagues who allege that state lawmakers violated the separation of powers doctrine by linking judicial and legislative pay raises.

Denying a bid by the state to dismiss the action, Supreme Court Justice Edward Lehner said in a ruling Tuesday the judges – who have not had a pay raise for nine years – had been “caught in the crosshairs between the executive and the legislature.”
