AstraZeneca Can't Duck Patent Claim Over Symbicort Inhaler

Law360, Washington (August 7, 2013, 3:20 PM EDT) -- A Texas federal judge ruled Tuesday that Accuhale LLC's suit alleging AstraZeneca LP infringed a patent for a pressurized metered-dose inhaler indicator could move forward, saying AstraZeneca hadn't proven that the patent was indefinite and invalid.

While U.S. District Judge Leonard Davis clarified various portions of claim language in U.S. Patent Number 5,718,355, titled "Indicator device responsive to axial force for use with inhaler,” he rejected AstraZeneca's request for summary judgment against one of the patent claims.
