Fidelity Beats Insurer At 1st Circ. In Water Damage Fight

Law360, New York (August 8, 2013, 2:52 PM EDT) -- Fidelity Co-Operative Bank on Wednesday won a ruling from the First Circuit providing coverage under a Nova Casualty Co. policy for serious water damage to an apartment building following a September 2008 tropical storm, setting up an insurance battle over business income losses.

In a published ruling, the First Circuit reversed Nova's summary judgment victory over Fidelity in a suit over coverage under an all-risk policy for major interior damage that shut down a five-story apartment building in Clinton, Mass.
