Unpaid Interns Take FLSA Battle To Supreme Court

Law360, New York (August 9, 2013, 5:04 PM EDT) -- A pair of former unpaid interns have asked the U.S. Supreme Court to resolve what they call a deepening circuit split as to whether they qualify as employees who should be compensated under the Fair Labor Standards Act.

In a petition for certiorari filed Wednesday, plaintiffs Risa Kaplan and Linda O'Neill argue they should been compensated for work they were required to perform at different clinics to earn an administrative degree in medical billing and coding from MedVance Institute in Florida.
