U.S. Joins Whistleblower Suit Against PharMerica

Law360, Chicago (August 9, 2013, 8:26 PM EDT) -- Nursing home pharmacy PharMerica Corp. has run afoul of U.S. drug laws and the False Claims Act by handing out powerful medications without proper prescriptions and then billing Medicare for it, according to a whistleblower suit unsealed Friday following government intervention.

The complaint filed in Wisconsin federal court alleges PharMerica “routinely” dispensed Schedule II narcotics like oxycodone and fentanyl at the request of nursing home staff and without a doctor’s written approval, violating the Controlled Substances Act.
