Small Biz Owners Seek KO In ACA Exchange Subsidy Suit

Law360, New York (August 12, 2013, 2:12 PM EDT) -- Small business owners challenging an Internal Revenue Service rule they allege unlawfully expands Affordable Care Act insurance subsidies and penalties asked a Washington federal judge Friday to grant them default judgment, saying the government failed to respond to a summary judgment bid on time.

According to the plaintiffs, the government should have responded to their summary judgment motion within 14 days of its June 6 filing, but had yet to do so, meaning they should be granted default judgment.
