Credit Card Debt Cos. Duck False Ad Suit In 5th Circ.

Law360, New York (August 13, 2013, 2:17 PM EDT) -- The Fifth Circuit on Monday cleared three debt-negotiation companies of Federal Trade Commission allegations that they misrepresented how much they could reduce customers' debt, although the court said that the commission might have won with a different argument.

In 2010, the commission sued Financial Freedom of America Inc., Debt Consultants of America Inc. and Debt Professionals of America Inc., as well as five people who owned or controlled the companies. The FTC said they violated the “unfair or deceptive acts or practices in or affecting commerce”...
