SEP Import Bans Still OK After Veto, InterDigital Tells ITC

Law360, New York (August 13, 2013, 4:19 PM EDT) -- InterDigital Communications LLC told the U.S. International Trade Commission on Monday that the recent White House veto of an exclusion order involving standard-essential patents should not prevent the ITC from banning imports of Nokia Corp. smartphones if they infringe InterDigital's essential patents.

Earlier this month, U.S. Trade Representative Michael Froman vetoed an exclusion order Samsung Electronics Co. Ltd. had won on older models of Apple Inc.'s iPhone found to infringe an essential patent. Froman ruled that ITC exclusion orders could give owners of such patents "undue leverage."...
