DC Circ. Orders NRC To Finish Reviewing Nuclear Waste Site

Law360, New York (August 13, 2013, 6:48 PM EDT) -- The D.C. Circuit on Tuesday ordered the U.S. Nuclear Regulatory Commission to move forward with safety reviews for a proposed nuclear waste site at Yucca Mountain, Nev., saying the agency had flouted the law by stopping work over policy and funding concerns.

The commission has said it had no choice but to stop because Congress hadn’t appropriated enough money to complete a full safety review. But the D.C. Circuit ruled in a 2-1 decision that the NRC had violated the Nuclear Waste Policy Act by halting consideration...
