Dollar General Rips EEOC Pre-Suit Legwork In Race Bias Suit

Law360, New York (August 13, 2013, 4:24 PM EDT) -- The U.S. Equal Employment Opportunity Commission failed to engage in required good-faith conciliation efforts before slapping a Dollar General Corp. subsidiary with a lawsuit claiming the company's use of criminal background checks disproportionately excluded black job applicants, Dollar General told a Chicago federal court Friday.

Dolgencorp LLC filed an answer to the EEOC's June 11 race bias complaint, denying that the agency had undertaken statutorily mandated, good-faith conciliation efforts, stating that the EEOC failed to meet the necessary pre-suit requirements before hauling the company into court....
