Millennium Labs' Kickback Suit Against Rival Survives

Law360, Washington (August 19, 2013, 1:50 PM EDT) -- A Florida federal judge on Friday denied Millennium Laboratories Inc.'s and Universal Oral Fluid Laboratories LLC's bids for an early win in Millennium's suit alleging Universal gave kickbacks to physicians using its testing services, saying there are factual issues that warrant advancing the case.

U.S. District Judge Mary S. Scriven determined that Millennium had provided sufficient evidence that Universal's physician agreements violate the Anti-Kickback Statute and Stark Law, giving the company enough steam to surpass Universal's request for summary judgment.
