6th Circ. Finds FBI Justified In Withholding Race Probe Data

Law360, New York (August 22, 2013, 5:17 PM EDT) -- The Sixth Circuit on Wednesday ruled the FBI properly applied exceptions to the Freedom of Information Act when it withheld data from the American Civil Liberties Union concerning its use of race and ethnicity in investigations.

A three-judge panel for the appeals court found the release of publicly available information that is selectively used by the FBI may reveal law-enforcement methods and priorities, which could interfere with enforcement actions.
