6th Circ. Revives CAA Suit Over Airport's $103M Funding

Law360, New York (August 21, 2013, 3:15 PM EDT) -- A whistleblower lawsuit accusing a Cleveland airport of lying to the government to obtain $103 million in federal funding can be brought under the Clean Air Act, a Sixth Circuit panel ruled on Tuesday.

The qui tam complaint, filed in 2010, alleges that the city didn't obtain a Title V permit; hasn't paid annual emission fees or environmental penalties; hasn't complied with Ohio's State Implementation Plan and falsely told the Federal Aviation Administration that it was in line with environmental laws in order to receive $103...
