Texas Court's Snub Sends BP Gas Delivery Suit To Arbitration

Law360, Houston (August 26, 2013, 4:20 PM EDT) -- Texas’ highest court declined Friday to review a decision that a BP PLC unit must arbitrate litigation over a natural gas contract even though the agreement does not expressly require arbitration, letting stand a ruling that the conflict is controlled by a separate agreement that does.

Without comment, the Texas Supreme Court rejected TOC-Rocky Mountain Inc.’s petition for review, which sought to overturn an intermediate appeals court’s ruling that a challenge to a natural gas delivery agreement inked by predecessors to TOC and Enterprise Field Services...
