Texas High Court Takes Up Same-Sex Divorce Cases

Law360, New York (August 26, 2013, 2:35 PM EDT) -- The Texas Supreme Court on Friday agreed to consider the constitutionality of the state’s law banning same-sex marriage and whether Texas has jurisdiction in no-fault same-sex divorces in two cases testing the impact of the U.S. Supreme Court’s recent Windsor and Hollingsworth decisions.

Texas’ high court granted petitions for review and scheduled oral argument for Nov. 5 in two cases brought by Texas same-sex couples who had married legally in Massachusetts but were later blocked from getting divorced in Texas, which does not recognize same-sex marriage....
