'Broad' Trade Secret Injunction Nixed In Noncompete Dispute

Law360, Dallas (August 27, 2013, 5:26 PM EDT) -- A Texas appeals court Monday reversed part of an injunction that barred a group of former electricity marketers for Ignite Holdings Ltd. and Stream SPE Ltd. from disclosing trade secrets during litigation over alleged violations of noncompete agreements, saying it didn’t adequately describe what information was protected.

The Fifth Court of Appeals of Texas didn’t address most of the temporary injunction’s provisions because they expired by their terms in May, but it struck two parts of the order that it said contained nonspecific terms. The decision...
