Calif. Appeals Court Says Challenge To Water Project Moot

Law360, Los Angeles (August 27, 2013, 4:34 PM EDT) -- A California appeals court on Monday overturned a lower court's ruling that the Marina Coast Water District must prepare a new environmental impact report for a regional desalination project, saying the matter is moot because the project has been canceled.

In a unanimous decision, a Sixth Appellate District panel overturned a Monterey County Superior Court's ruling granting environmental group Ag Land Trust a writ of mandate compelling the MCWD to draft a new EIR for the project.
