Disbarred Fen-Phen Attys Take $42M Hit In Ky. High Court

Law360, New York (August 29, 2013, 3:48 PM EDT) -- The Kentucky Supreme Court on Thursday restored a $42 million judgment against three attorneys who allegedly looted a $200 million settlement fund for victims of the diet drug fen-phen, saying a state appeals court improperly interpreted testimony from a mass tort expert.

A unanimous panel said the state Court of Appeals was wrong to nix a trial court’s ruling that the attorneys breached fiduciary duty as a matter of law by stealing from the settlement fund and were liable for $42 million based on “simple arithmetic.”...
