QBE Not Liable For Wilma-Damaged Condo, Fla. Judge Rules

Law360, New York (August 30, 2013, 4:30 PM EDT) -- A Florida magistrate judge on Friday dismissed a suit brought by a condominium association accusing QBE Insurance Corp. of failing to fully repay it for damage incurred during Hurricane Wilma, finding that the plaintiff failed to meet its burden of proof and didn't comply with its post-loss obligations.

The suit is one of 12 alleging that QBE failed to fully assess claims and refused to pay for damages to windows and sliding doors caused by the 2005 hurricane, and one of three to make it to trial, according to an attorney for the defendant.
