8th Circ. Tosses ABF Freight's $750M Union Concession Suit

Law360, Los Angeles (August 30, 2013, 6:55 PM EDT) -- The Eighth Circuit on Friday affirmed the dismissal of ABF Freight System Inc.'s $750 million lawsuit claiming the International Brotherhood of Teamsters granted selective wage and hour concessions to a rival trucking company, saying the company didn't exhaust its options for grievance resolution before filing suit. 

A three-judge panel agreed with U.S. District Judge Susan W. Wright that ABF should have brought its grievance against the IBT and rival company YRC Inc. in an internal dispute resolution system, not federal court.
