Huntington Ingalls Asks 4th Circ. To Rehear NLRB Case

Law360, New York (September 3, 2013, 6:05 PM EDT) -- Huntington Ingalls Inc. on Friday asked a Fourth Circuit panel to reconsider its decision regarding a National Labor Relations Board order finding that the company failed to bargain with a union, arguing the court shouldn't have even considered the case because the NLRB lacked a quorum when it issued the order.

In its petition, the Virginia-based shipbuilding company asked the court for a panel or en banc rehearing of its July ruling, insisting that the court should have addressed the company’s challenges to the NLRB’s jurisdiction...
