Newegg Gets Fed. Circ. To Nix Another Soverain Patent Claim

Law360, New York (September 4, 2013, 5:19 PM EDT) -- The Federal Circuit on Wednesday invalidated an additional claim of a Soverain Software LLC e-commerce patent asserted against Newegg Inc. and denied Soverain's bid for an en banc rehearing of an earlier decision.

The court ruled Wednesday that both claim 34 and claim 35 of U.S. Patent Number 5,715,314 that Soverain asserted against Newegg are invalid as obvious, clarifying its January ruling both parties had said was unclear over claim 35's validity. Claim 34 is representative of the "shopping cart" claims at issue in the case and claim...
