Whistleblowers Back $19M FCA Penalty Against Nursing Home

Law360, New York (September 6, 2013, 2:33 PM EDT) -- An Illinois nursing home should pay $19 million for committing Medicare and Medicaid fraud rather than a $9 million penalty issued by a federal court, whistleblowers told the Seventh Circuit on Thursday.

The trial court in February entered a $9 million judgment for treble damages from bogus bills Momence Meadows Nursing Center Inc. had submitted, but refused to enter judgment on another $19 million in False Claims Act penalties levied by a jury, ruling that those penalties violated the Eighth Amendment's prohibition on excessive fines....
