Noerr Doctrine No Help To Insurer In Ford Coverage Suit

Law360, New York (September 9, 2013, 3:28 PM EDT) -- A Berkshire Hathaway Inc. insurance unit failed Friday to escape Ford Motor Co.’s lawsuit over more than $20 million in disputed coverage for product liability claims, with a Virginia federal judge ruling that the insurer’s alleged obstruction of the payouts wasn’t constitutionally protected conduct.

National Indemnity Co. is accused of trying to duck its obligations under a reinsurance contract with HDI-Gerling, a financially troubled German insurer that issued policies to the automaker, and of tortiously interfering with Ford’s ability to recoup its losses under those policies....
