Payless Hit With OT Suit In Pa. Over Fluctuating Workweek

Law360, New York (September 10, 2013, 5:58 PM EDT) -- Payless Shoesource, Inc. was hit with a class action in Pennsylvania state court Monday alleging the company’s fluctuating workweek model for calculating overtime pay ran afoul of Pennsylvania wage laws, which require time-and-a-half for any time worked beyond 40 hours per week.

Payless store manager Barbara Warcholak filed the complaint in the Philadelphia County Court of Common Pleas on behalf of a class of workers alleging they were significantly underpaid for their hours due to the store’s fluctuating workweek policy.
