Docs In Cephalon Pay-For-Delay Row Protected, Judge Says

Law360, New York (September 11, 2013, 6:33 PM EDT) -- A Pennsylvania federal judge ruled Wednesday that attorney-client privilege prevented the release of most of the documents sought by the Federal Trade Commission in an antitrust suit accusing Cephalon Inc. of improperly delaying generic versions of its narcolepsy drug.

After conducting an in camera review, U.S. District Judge Mitchell Goldberg denied a significant part of the FTC's motion to compel the production of documents withheld or redacted during discovery, ordering that Cephalon only has to turn over one of the 54 requested documents.
