States Claim EPA Can't Limit Power Plant Emissions

Law360, New York (September 13, 2013, 3:11 PM EDT) -- Officials from 18 states on Thursday accused the U.S. Environmental Protection Agency of trampling states' authority under the Clean Air Act as it contemplates a rule capping greenhouse gas emissions from existing power plants, arguing that states have the final say on any emissions standards.

A revised EPA rule capping greenhouse gas emissions from new power plants is due Sept. 20, while President Barack Obama has directed the agency to craft a proposal for existing power plants by 2014 that must be finalized within a year....
