Pa. Towns Can't Set Zoning Rules For Propane Storage

Law360, Philadelphia (September 13, 2013, 5:23 PM EDT) -- The Pennsylvania Commonwealth Court ruled Friday that state law prevented a municipality from subjecting a proposed bulk propane storage facility to local zoning control, upholding a trial court's decision and dealing a blow to residential groups who object to the project.

In a split decision, the appeals court determined that the state’s Propane and Liquefied Petroleum Gas Act prevented the Dingman Township Zoning Hearing Board from regulating safety and setback requirements.
