Microsoft Can't Sue DHS For Motorola Imports, Court Hears

Law360, New York (September 16, 2013, 12:49 PM EDT) -- The U.S. Department of Homeland Security on Friday told a D.C. federal judge that Microsoft Corp. has no grounds to sue the government over the agency's decision to allow imports of certain Motorola Inc. mobile devices that Microsoft claims have been found to infringe on its patents.

In a 20-page motion to dismiss the suit, DHS told the court that Microsoft has numerous administrative remedies at its disposal to address the discrepancy, all of which supersede the software giant's allegations under the Administrative Procedure Act....
