Detroit Says Kirkland Atty Can’t Testify In Syncora Row

Law360, New York (September 17, 2013, 2:28 PM EDT) -- A Kirkland & Ellis LLP attorney who represents bond insurer Syncora Guarantee Inc. in Detroit’s historic bankruptcy proceedings should not be allowed to testify because she would abuse the attorney-client privilege, the city told a Michigan bankruptcy judge on Monday.

Undergoing the largest municipal bankruptcy in American history, Detroit said that Kirkland attorney Alexandra Schwarzman would be too selective about what she will discuss, using a “gross misapplication of the attorney-client privilege” to answer only questions beneficial to Syncora.
