10th Circ. Revives Tribal Oil And Gas Royalty Suit

Law360, Los Angeles (September 17, 2013, 7:15 PM EDT) -- The Tenth Circuit on Tuesday reversed an Oklahoma federal court’s dismissal of the claims of members of the Osage Nation who are seeking to force the U.S. government to reveal how much is earned and paid out of tribe-owned oil fields.

The three-judge panel found the district court had erred in its finding that a statute requires the government to reveal how much money it deposits into tribe bank accounts from the oil royalties, but not how much money it collects in royalties before it makes...
