No Need To Rehear Loan Officer OT Case, DC Circ. Told

Law360, New York (September 19, 2013, 2:41 PM EDT) -- A banking industry group told the D.C. Circuit on Wednesday that a panel decision striking down the U.S. Department of Labor's 2010 reclassification of mortgage loan officers as eligible for overtime pay does not merit a full court review.

The Mortgage Bankers Association urged the appeals court to reject a petition for en banc review lodged by by three former Quicken Loans Inc. loan officers, who intervened in the trade group's case against the DOL challenging the interpretive change because they have pending claims for unpaid overtime....
