Warner Bros. Can't Nix Hotfile's DMCA Abuse Claims

Law360, New York (September 23, 2013, 4:19 PM EDT) -- A Florida federal court ruled last month that file hosting site Hotfile Corp. could proceed on claims that Warner Bros. Entertainment Inc. abused take-down procedures by deleting content it didn't own, according to court documents unsealed Friday.

The Aug. 28 ruling was widely reported at the time, but only based on media statements from the Motion Picture Association of America that said the court had ruled that Hotfile wasn't protected by the Digital Millennium Copyright Act's safe harbor provisions.
