Calif. Court Revives Discrimination Suit Over Waste Project

Law360, New York (September 23, 2013, 7:52 PM EDT) -- A California appeals court on Friday partially revived a discrimination lawsuit against the city of Los Angeles over its approval of a waste facility project in a predominantly Latino area, saying a lower court was wrong to toss environmental law claims over a procedural delay.

A divided appellate panel upheld the dismissal of plaintiff Comunidad en Accion's claim against the City Council under a state anti-discrimination statute, but overturned the dismissal of the group's California Environmental Quality Act claim after finding that a hearing request deadline...
