Fla. Enviro Agency Can't Move Inverse Condemnation Case

Law360, Los Angeles (September 23, 2013, 7:22 PM EDT) -- A Florida appeals court on Monday denied the state Department of Environmental Protection's request to change venue in an inverse condemnation suit brought by property owners over a state-created erosion control line, ruling the agency waived the issue by not raising it sooner.

Upholding a trial judge's decision, a three-judge panel said the Circuit Court of Leon County was a proper venue to hear the case because it is where the property in dispute was located.
