Engineering Firm Wins Cracked Reservoir Row In 11th Circ.

Law360, Miami (September 25, 2013, 5:10 PM EDT) -- The Eleventh Circuit on Monday affirmed a district court's pretrial decisions allowing HDR Engineering Inc.'s expert testimony and evidence that a Tampa, Fla. water authority said should have been barred in the trial over liability for abnormal cracking in a drinking water reservoir.

The appeals court said the district court did not abuse its discretion when it allowed HDR, which had designed the reservoir, to present evidence at trial that Barnard Construction Co. Inc., which settled out of the suit, had caused the reservoir damage. HDR...
