FERC Has Authority To Reform Power Planning, DC Circ. Told

Law360, New York (September 25, 2013, 5:21 PM EDT) -- The Federal Energy Regulatory Commission told the D.C. Circuit on Wednesday that it has the authority to reform the planning of high-voltage power transmission, despite protests from electric utilities that a new agency rule oversteps the commission's bounds.

According to FERC's brief, the appeals court should dismiss claims against its requirement in Order No. 1,000 that FERC-jurisdictional electric transmission providers participate in a regional planning process to take into account state and local public policy when outlining a regional plan and to coordinate with other providers...
