SC High Court Holds Indirect Damage Flows From 'Occurrence'

Law360, New York (September 26, 2013, 4:38 PM EDT) -- The South Carolina Supreme Court held Wednesday that tangential damage tied to defective construction resulted from an “occurrence,” siding against Auto-Owners Insurance Co. in a coverage fight stemming from a fallen billboard that prompted a now-overturned $6.5 million verdict.

According to the decision, the removal of two billboard signs that Auto-Owners Insurance's policyholder erected in South Carolina was caused by an occurrence, or accident, that would be covered by a commercial general liability policy.
