Safeway Rehashed Doryx Antitrust Claims In New Suit: Judge

Law360, New York (September 30, 2013, 7:31 PM EDT) -- A Pennsylvania federal judge on Monday rebuked Safeway Inc. and HEB Grocery Co. LP for filing a new complaint against Warner Chilcott Public Ltd. Co. with the same claims the judge had refused to let them belatedly add to consolidated antitrust litigation over acne drug Doryx.

U.S. District Judge Paul Diamond stayed the supermarket chains' complaint until the consolidated litigation over Warner Chilcott's allegedly anti-competitive strategies to prevent generic versions of its Doryx medication from entering the market is resolved.
