High Court Case May Give New Weapon Against Patent Trolls

Law360, New York (October 1, 2013, 10:08 PM EDT) -- The U.S. Supreme Court's decision Tuesday to review whether district court decisions ordering sanctions against filers of "objectively baseless" patent suits are entitled to deference on appeal could give accused infringers a powerful tool to use against so-called patent trolls, attorneys say.

The high court agreed to hear an appeal by health insurer Highmark Inc., which argues that the Federal Circuit's standard of reviewing such sanctions afresh on appeal makes it too easy to get them overturned and "gives trolls more leverage to extort licensing fees...
