MedWaste Settles $10M TCPA Suit, Puts Insurer On The Hook

Law360, New York (October 3, 2013, 3:20 PM EDT) -- Med Waste Management LLC on Wednesday agreed to a $10 million settlement that resolves a class action alleging the company illegally sent unsolicited faxes — but its insurer, James River Insurance Co., might end up on the hook for the deal.

The class had alleged that Med Waste and its officers violated the federal Telephone Consumer Protection Act and regulations promulgated by the Federal Communications Commission by faxing advertisements that did not contain a clear and conspicuous notice that complied with the TCPA and FCC regulations....
