9th Circ. Urged To Rethink Calif. Carbon Fuel Standard

Law360, New York (October 3, 2013, 5:16 PM EDT) -- Trade associations and energy lobbyists on Wednesday urged the Ninth Circuit to reconsider its decision backing California’s Low Carbon Fuel Standard aimed at dramatically reducing greenhouse gas emissions, arguing the ruling directly conflicts with U.S. Supreme Court precedent.

The groups had sought to shut down the LCFS on the grounds that it discriminated against fuels and fuel feedstocks imported from outside California by including emissions spent on transportation in its greenhouse gas emissions metric.
