EPA’s Passive-Aggressive Use Of Title V Objections

Law360, New York (October 10, 2013, 2:59 PM EDT) -- On Sept. 13, 2013, the U.S. Environmental Protection Agency won a legal battle against the Louisiana Department of Environmental Quality (LDEQ) over the EPA’s use of late Title V objections to retroactively challenge New Source Review (NSR) authorizations.[1] The case was the latest in a series of state challenges to EPA oversight and authority under the federal Clean Air Act.
