Device Maker Fights OIG's 'Inherently Suspect' Claim

Law360, New York (October 9, 2013, 3:53 PM EDT) -- Reliance Medical Systems LLC on Tuesday sued the U.S. government in California in an effort to discredit a federal inspector general's declaration that physician-owned medical device companies are "inherently suspect," claiming the government is trying to illegally stamp out such businesses.

Reliance is seeking a declaration that the comment, made by the U.S. Department of Health and Human Services' Office of Inspector General in March, is inaccurate and invalid, and that physician-owned companies that distribute implantable medical devices are not inherently suspect under anti-kickback laws, according...
