Fla. Appeals Court Won't Revive Colombian Native's Engle Suit

Law360, Miami (October 9, 2013, 1:54 PM EDT) -- A Florida appeals court on Wednesday refused to revive an Engle progeny case brought by family members of a Colombian native against Philip Morris Inc., affirming a lower court's ruling that the deceased relative was not a state resident and was ineligible to bring the suit.

In a per curiam ruling issued without comment, Florida's Third District Court of Appeal affirmed the January 2012 decision by the Eleventh Judicial Circuit finding that Marco Duque's lawsuit was barred by the statute of limitations.
