Monsanto Wins Arbitration Bid In Defective Cottonseed Row

Law360, New York (October 9, 2013, 5:34 PM EDT) -- A Louisiana appeals court shipped a dispute between Monsanto Ag Products LLC and a group of cotton farmers over allegedly defective seed into arbitration on Wednesday, reversing a lower court’s finding that a contractual arbitration clause was “almost unconscionable.”

The Louisiana Second Circuit Court of Appeals roundly rejected a lower court’s finding that a suit brought by more than a dozen farmers over purportedly faulty Monsanto-patented transgenic cottonseed need not be arbitrated because Monsanto’s superior bargaining power made an arbitration clause in its contract unenforceable....
