Whistleblower Wants Omnicare Sanctioned In FCA Suit

Law360, New York (October 10, 2013, 2:27 PM EDT) -- A whistleblower who filed a False Claims Act action accusing Omnicare Inc. of paying nursing homes Medicare kickbacks for referrals asked a Ohio federal judge Wednesday to sanction the pharmacy services company for missing discovery deadlines in the litigation in an attempt to derail the case.

In a motion filed with the Northern District of Ohio, former Omnicare employee Donald Gale asked the court to enter default judgment on liability issues against Omnicare for its "flagrant gamesmanship" in refusing to produce 75 percent of requested documents...
