Allergan Seeks Escape From Surgical Centers' Lap-Band Suit

Law360, Los Angeles (October 10, 2013, 4:31 PM EDT) -- A California judge expressed doubts Thursday about five California surgical centers' claims that Allergan Inc. assisted 1-800-Get-Thin clinics in unfairly competing for Lap-Band weight loss device customers, suggesting plaintiffs hadn’t shown how the health care company had profited at their expense.

Los Angeles Superior Court Judge William F. Fahey said the 1-800-Get-Thin clinics appeared to be the “real culprits” in the surgical centers' $15 million suit alleging the clinics falsely advertised that they met Allergan's purported medical standards for use of the Lap-Band product in order to gain...
