Merck KGaA Sues NJ Supplement Biz For Use Of Folate Mark

Law360, Chicago (October 10, 2013, 7:46 PM EDT) -- German pharmaceutical company Merck KGaA sued a New Jersey dietary supplement company in federal court on Wednesday, alleging unfair competition and that the company is falsely claiming one of its products contains a trademarked Merck folate supplement.

Santegra Inc.’s Menofix supplement allegedly boasts directly on its packaging that one of its ingredients is Metafolin — the folate made by Merck — but the German company has never sold any of the product to Santegra or authorized it to use the trademark, according to Wednesday's complaint. ...
