Fed. Circ. Won't Review Ruling Nixing Cordis Stent Patents

Law360, New York (October 11, 2013, 7:49 PM EDT) -- The full Federal Circuit on Friday declined to review a ruling that two Cordis Corp. and Wyeth Pharmaceuticals Inc. patents covering a drug used in stents are invalid, turning aside the companies' claim that the ruling "will cast doubt upon the validity of large numbers of existing patents."

In a June decision, a panel of the Federal Circuit held that the patents are invalid for lack of enablement because one skilled in the art could not practice the full scope of the patents without undue experimentation....
